This Privacy Policy describes the practices of The Mold Marshal ("The Mold Marshal," "we," "us," or "our") regarding the collection, use, and disclosure of information we collect when you use our website, themoldmarshal.com (the "Service"). By accessing or using the Service, you are consenting to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not consent, please do not access or use the Service.

We may update this Privacy Policy from time to time. Updates take effect as soon as the revised version is posted on the Service, and we will update the effective date above. For changes that materially affect how we use information we've already collected, we'll provide more prominent notice (for example, by email). We recommend checking this page periodically.

What personal information do we collect from people who visit or use our website?

When you request a quote or schedule an inspection, you may be asked to provide your name, email address, phone number, property address, and billing information.

When we perform an inspection at your property, we also collect photographs, moisture readings, thermal imaging, and air or surface sample data, along with the laboratory results from any samples we submit on your behalf.

What we don't ask for.
Our forms, calls, and inspection process don't ask you to share information about your or any household member's medical conditions, symptoms, or health status. If you choose to volunteer that kind of information to explain why you want testing, we use it only to fulfill your request — never for marketing or analytics — and we don't sell or share it with anyone outside of delivering the service you asked for.

How do we share your information?

We do not sell your personal information. We share it only in these circumstances:
Service providers, including the laboratories that analyze samples, and the scheduling, payment processing, and email/text providers we use to run the business
At your direction — for example, if you ask us to send your inspection report to a landlord, real estate agent, attorney, or insurance company
Analytics and advertising providers, if we use them (see Cookies, below) — and only with aggregated or non-identifying information
Legal compliance — to comply with the law, a subpoena, or court order, or to protect our rights or the safety of our customers
Business transfer — if The Mold Marshal is acquired by or merges with another company, your information may transfer as part of that deal, subject to this Policy

Any third party we share information with is required to use it only for the purpose we shared it for, and not retain it longer than necessary.

How do we protect your information?
We restrict access to personal and inspection data to the people who need it to do their work, and we use reasonable administrative, technical, and physical safeguards to protect it. Payment transactions are processed through our payment provider and are not stored on our own servers. No method of transmission or storage is completely secure, and we can't guarantee absolute security.

Do we use cookies?
Yes. Cookies are small files your browser stores that let our site recognize you on return visits. We use them to remember your preferences and to understand site traffic and how visitors use the site, so we can improve it over time. We also use analytics tools such as Google Analytics, and advertising/retargeting pixels such as Meta Pixel or Google Ads. Do Not Track
Our site does not currently respond to Do Not Track (DNT) browser signals, as there is no accepted industry standard for how to do so.

CalOPPA (California Online Privacy Protection Act)
In line with CalOPPA, visitors can browse our site anonymously. A link to this Privacy Policy appears on our homepage. You can update or correct your personal information, or ask questions about this policy, by emailing us at themoldmarshal@gmail.com.

COPPA (Children's Online Privacy Protection Act)
Our services are directed at adults, not children. We do not knowingly collect personal information from anyone under 13, and if we learn that we have, we'll delete it.

Fair Information Practices / Data Breach Notification
If a data breach affecting your personal information occurs, we will notify you without unreasonable delay and in line with Washington's data breach notification law (RCW 19.255), which generally requires notice within 30 days of discovery. You have the right to pursue legally enforceable remedies against data collectors who fail to comply with applicable privacy laws.

CAN-SPAMWe collect your email address to respond to inquiries, send appointment and results information, and, if you've opted in, send occasional marketing updates. In line with CAN-SPAM, we won't use misleading subject lines, we'll identify marketing messages as such, we'll include our physical business address in marketing emails, and we'll honor unsubscribe requests promptly — just use the link at the bottom of any email, or email us directly.

Your rights

Washington residents: Washington's My Health My Data Act gives Washington consumers specific rights over "consumer health data." As noted above, we don't knowingly collect this category of information through our website or intake process.
